Lot

Website Terms of Use

1. About these terms

These terms apply to the public website at lot.net.au and its enquiry forms. References to “Lot”, “we”, “us” and “our” mean the Lot business presented on this website. You can contact the Lot team through Talk to Lot.

These are website-use terms, not a strata-management contract. They do not appoint Lot, authorise us to act for a body corporate or owners corporation, or replace a separately agreed service or acquisition agreement. They do not change rights or obligations imposed by legislation.

2. Website information

Our website introduces Lot and provides general information about our approach to strata management and business enquiries. We aim to keep it accurate and current. Information about a particular building, service or proposal should be confirmed with us before you make a decision.

General website content is not advice about your specific legal, financial, tax, insurance or building-safety circumstances. Strata requirements differ between states, territories and scheme types. Seek appropriately qualified advice where your circumstances require it.

Illustrations and animations are representations of community life. They are not photographs of buildings we manage, evidence of customers, or promises about a particular property. Descriptions of technology and service improvements do not guarantee a specific saving, response time or outcome unless expressly agreed.

3. Enquiries and strata-management appointments

Submitting a form starts a conversation. An acknowledgement confirms receipt; it does not confirm that Lot has accepted an appointment, agreed to carry out work, or approved a request on behalf of a building.

Before an appointment proceeds, the relevant parties must agree the services, fees, responsibilities and other engagement terms, and obtain any approvals required by the applicable strata legislation. A resident, owner or committee member making an enquiry should not assume that they alone can bind the body corporate or owners corporation.

A management appointment does not automatically transfer every decision or duty of a body corporate, owners corporation or committee to its manager. The relevant legislation, valid decisions and the agreed scope of appointment determine who can act and what authority they have.

If you already have a management agreement, use the contact and service channels specified in that agreement for operational instructions and requests. Nothing on this website varies that agreement without the agreement and process required by its terms and applicable law.

4. Fees, proposals and offers

Any proposal should identify the service scope, fees, GST treatment, additional charges and applicable conditions before you commit. Ask us to clarify anything that is not clear. Website enquiries do not create an obligation to pay for management services.

Read any promotional offer together with the information displayed alongside it and the written proposal for your building. A discount or waiver of a strata-management fee does not mean that body corporate levies, insurance, repairs, maintenance, utilities or other third-party costs are waived. We will explain any separately charged services before you agree to them.

These website terms do not introduce a minimum service term, an automatic renewal, an exit fee or a payment authority. Those matters, if relevant, must be addressed transparently in the proposed engagement and remain subject to applicable law.

5. Urgent issues and formal notices

Website forms are for enquiries and are not an emergency response service. For an immediate threat to life or safety, call 000. For an urgent building issue, follow your building’s emergency arrangements and contact its current manager or the appropriate emergency contractor.

Do not rely on this website form to meet a statutory deadline, lodge a formal notice, make a tribunal application, authorise urgent work or serve legal documents. Use the method required by the relevant law, authority or existing agreement. An automated form acknowledgement is not confirmation that any such requirement has been met.

6. Enquiries about selling a business

A business enquiry is an invitation to discuss possibilities. It is not an offer to purchase, a valuation, a funding commitment or an assurance that a transaction will proceed.

Use the initial form for a brief introduction. Do not send confidential financial records, client lists, employee records or resident information through it. If further discussions require confidential information, the parties should first agree appropriate confidentiality arrangements, authority to disclose and a suitable method of sharing it. An initial enquiry does not itself create a non-disclosure agreement.

7. Responsible use of the website

Please use the website lawfully and provide information that is accurate to the best of your knowledge. Do not impersonate another person or misrepresent your authority to act for a building or business.

We may take proportionate steps to prevent misuse, including filtering submissions or restricting abusive traffic. A website access restriction does not, by itself, terminate a separate service agreement or remove your legal rights.

8. Content and intellectual property

Website text, branding, artwork, animations and code are owned by Lot or the relevant rights holders. You may view the site and download or print reasonable extracts for personal use or internal consideration of Lot’s services, retaining any ownership notices.

For other uses, including republishing our illustrations, using our brand in advertising or representing that Lot endorses your business, obtain permission first. This does not limit uses permitted by copyright law or other applicable law.

You retain ownership of material you submit. You permit us to use and share it only as reasonably needed to handle your enquiry, provide an agreed service, or as otherwise explained in our Privacy Policy and permitted by law. Sending material does not give us an unrestricted right to publish it or use it in advertising.

9. Privacy and third-party services

Our Privacy Policy explains what personal information the website collects, how enquiries are delivered, overseas processing, and how to request access or correction or raise a concern. It is a notice about information handling, not a blanket consent to unrelated uses of your information.

The website uses external hosting, email and analytics providers and may link to other websites. Those external sites have their own terms and privacy practices. A link is not necessarily an endorsement. Using a provider does not remove any responsibility we have under applicable law.

10. Availability and responsibility

We may maintain, update or temporarily interrupt the website. We cannot promise that every page or enquiry transmission will always be available or error-free. If a form reports an error, your enquiry may not have reached us; follow the on-screen guidance or try again later.

Please take reasonable precautions when using the internet and let us know about errors or suspected security issues. We will assess reported problems and take reasonable steps appropriate to the circumstances.

Responsibility for loss arising from this website is determined under applicable law. These terms do not impose a general indemnity on visitors, set a nominal liability cap, or exclude responsibility that cannot lawfully be excluded. Rights and responsibilities for separately contracted services are also governed by the relevant agreement and legislation.

11. Your consumer rights

Nothing in these terms excludes, restricts or modifies consumer guarantees, remedies or other rights under the Australian Consumer Law or any other law where doing so would be unlawful. Where those protections apply, they take priority over any inconsistent wording on this website.

For information about statutory consumer guarantees, see the ACCC’s consumer rights guidance. These website terms do not replace those protections with a discretionary remedy.

12. Questions, complaints and disputes

Contact us through Talk to Lot with a brief description of the issue and the outcome you seek. We will review it and respond using the contact details you provide. Privacy complaints follow the process in our Privacy Policy.

We encourage direct discussion, but you do not have to give up access to a regulator, applicable dispute-resolution body, tribunal or court. These terms do not require private arbitration, prevent urgent relief or shorten a statutory time limit. Disputes about a building or management appointment may have a specific statutory process separate from a website complaint.

13. Changes and applicable law

We may update these website terms to reflect changes to the site or applicable law. The date at the top identifies this version. Changes apply prospectively; they do not retrospectively alter an agreed transaction or a separate signed agreement. Material changes affecting an ongoing arrangement will be addressed through the notice and agreement process applicable to that arrangement.

These website terms are governed by the laws of Queensland, Australia, subject to any mandatory laws and protections that apply in another jurisdiction. Queensland courts have non-exclusive jurisdiction; this does not prevent you from using another court or tribunal where the law allows.

If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent they can operate lawfully. No provision overrides a right that cannot be waived.
